On July 15, 2008, Pierre Foods, Inc. and certain of its affiliates (collectively the “Debtors”) filed voluntary petitions for reorganization under chapter 11 of the United States Bankruptcy Code in the United States Bankruptcy Court for the District of Delaware (the “Court”). The Court ordered the Debtors’ cases to be jointly administered under case number 08-11480 (KG).
On July 28, 2008, the Office of the United States Trustee for the District of Delaware appointed a committee of unsecured creditors (the “Creditors’ Committee”). The Court entered an order, dated November 19, 2008, appointing The Garden City Group, Inc. as the official communications agent for the Creditors’ Committee.
On December 10, 2008, the Court entered an order confirming the Second Amended Joint Plan of Reorganization of Pierre Foods, Inc. and Its Affiliates under Chapter 11 of the Bankruptcy Code with Technical Modifications, dated December 8, 2010 (the “Second Amended Plan”), and on December 12, 2008, the Second Amended Plan went effective.
